Cleveland Clinic Wellness Programs Waiver Agreement / Release
This Waiver Agreement/Release (hereafter referred to as “Agreement”) is entered into as of the date accepted by you (hereafter referred to as “Undersigned”) electronically, by and between The Cleveland Clinic Foundation on behalf of its Wellness Institute (hereafter referred to as “CCF”) and the Undersigned. CCF hosts a variety of wellness programs and classes (hereafter referred to as “Programs”) within their facilities and on their premises. From time to time, the Undersign may participate in various Programs that CCF offers. WHILE ON CCF PREMISES, THE UNDERSIGNED AGREES TO TAKE FULL RESPONSIBILITY FOR HIS OR HER HEALTH CHOICES, INCLUDING, BUT NOT LIMITED TO THE CHOICE TO PARTICIPATE IN ANY PROGRAMS, AND MAY SEEK MEDICAL ADVICE FROM HIS OR HER PHYSICIAN TO BE CLEARED FOR THE PROGRAMS PRIOR TO BEGINNING THE PROGRAMS. CCF IS NOT RESPONSIBLE FOR THE UNDERSIGNED’S FAILURE TO ENGAGE HIS OR HER PHYSICIAN OR FOR DAMAGE THAT MAY RESULT FROM THE FAILURE TO DO SO.
The Undersigned hereby agrees and represents, for himself or herself, they are 18 years of age or older, that all activity, exercises, treatments, food consumption and use of CCF’s facilities shall be undertaken at his/her own risk, that he/she is physically able to undertake any and all physical exercises and offerings provided and that CCF, its officers, agents, and employees shall not be liable for any claims, damages, injuries, actions, or causes of action whatsoever to the Undersigned or to the property of the Undersigned, or to the executors, heirs, or assigns of the Undersigned, arising out of or connected with participation in the Programs offered. DUE TO THE NATURE OF THE PHYSICAL EXERCISE THAT MAY OCCUR DURING ANY PROGRAMS WHILE ON CCF’S PREMISES INDIVIDUALS WITH ANY KNOWN SERIOUS MEDICAL CONDITION AND WOMEN WHO ARE PREGNANT OR WHO SUSPECT THAT THEY MAY BE PREGNANT SHOULD FIRST RECEIVE APPROVAL FROM HIS/HER PHYSICIAN. THE UNDERSIGNED HEREBY FOREVER RELIEVES, RELEASES AND DISCHARGES CCF ITS OFFICERS, AGENTS AND EMPLOYEES FROM ANY AND ALL CLAIMS, DEMANDS, CAUSES OF ACTION, OBLIGATIONS, DAMAGES, ATTORNEY’S FEES, COSTS AND LIABILITIES OF ANY NATURE WHATSOEVER RELATED TO OR ARISING OUT OF THE UNDERSIGNED’S PARTICIPATION IN THE PROGRAMS OFFERED. THE UNDERSIGNED, ALSO SHALL INDEMNIFY AND HOLD HARMLESS CCF FROM ANY AND ALL CLAIMS, ACTIONS, SUITS, PROCEDURES, COSTS, EXPENSES, DAMAGES AND LIABILITIES, INCLUDING ATTORNEY’S FEES, THAT RESULT FROM THE UNDERSIGNED’S PARTICIPATION IN OR INVOLVEMENT WITH ANY PROGRAMS ON CCF’S PREMISES.
Only in consideration of these terms, CCF agrees to permit access to its Programs upon the execution of this Agreement. Such access may be revoked if the Undersigned violates any rule of a class, including this Agreement. The Undersigned agrees by selecting checkbox while registering online.
